Any and all changes to this Agreement will also be reflected on the Site. It is therefore important that you regularly review this Agreement and keep your contact information current to ensure you are informed of any changes.
If you are dissatisfied with the Site or any content on the Site, your sole and exclusive remedy is to discontinue using the Site.
THE SALE OF ALCOHOLIC BEVERAGES
You agree that any alcohol purchased from hamilton.wine is intended for personal consumption and not for resale. hamilton.wine does not sell alcohol to persons under the age of 21 and makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, you may be prosecuted to the full extent allowable by law.
In order for You to purchase merchandise through the Site, You will be required to provide us with certain information. To do so, you may choose to become a registered customer with us. You agree and represent that all registration and billing information provided by You is accurate and up-to-date. Recognizing the global nature of the Internet, you further represent and warrant that you will comply with all local rules regarding online purchases of alcoholic products.
OUR PRODUCTS AND CUSTOMER SERVICE
DESCRIPTIONS. Hamilton Family Wine attempts to be as accurate as possible in its products descriptions. However, Hamilton Family Wine does not warrant that product and price descriptions or other content of this Site is accurate, complete, reliable, current, or error-free. If a product offered by Hamilton Family Wine itself is not as described, your sole remedy is to return it in unused condition. Hamilton Family Wine also reserves the right to cancel any orders resulting from such errors.
PRODUCT WARRANTY: Hamilton Family Wine warrants that all its products purchased through hamilton.wine will be free from defects in materials or workmanship for thirty (30) days from the date of original purchase. The warranty does not cover damages resulting from misuse by the owner or third parties and acts beyond Hamilton Family Wine’ control. The warranty does not cover incidental or consequential damages.
Products can be returned or exchanged at Hamilton Family Wine within 30 days of receipt by you or the recipient or such longer period as required by applicable law. To return an item please contact customer service to request a Return Merchandise Authorization number (RMA#). Your shipment will be refused if your RMA# is not clearly marked on the outside of the package. The customer is responsible for cost of shipping to the Customer Service. After inspection of the returned merchandise, you will receive store credit for cost of the returned merchandise only; shipping is non-refundable. For exchanges, a new charge will be made to the credit card for the merchandise only. Exchange items are shipped via UPS Ground at no additional charge to the customer. A credit may be used to purchase merchandise at www.hamilton.wine or calling us at 1-707-408-3090. Store credit is not activated until 24 hours after purchase. We will not offer an exchange or a refund for any item that is not received by us after you send it. Please note that costs we incur in connection with orders canceled before delivery will be charged to your account.
To the extent you are returning items you received as a gift, you may return merchandise by indicating that the item is a gift at the time of return, and we will issue a credit for future purchase in the amount of the returned items valid for a period of 12 months from the date issued at the address you indicate at the time of return.
SPECIAL ORDERS: Please note that to the extent any products are special-order items, they are not returnable and that all such sales are final.
Replacement products will be shipped back to you free of cost via UPS addresses within the continental United States only (we cannot ship to Hawaii, Alaska or Puerto Rico), subject to applicable law. We accept online orders for wine shipping to most states. However, because of the three-tier system (producer, wholesaler, retailer) through which most alcoholic products must pass in the United States, and due to evolving direct-shipping laws and regulations, distribution and shipping of alcoholic products can be complicated and the list of states and areas within those states that we ship to varies and may change at any time. We will contact you by email if your order is negatively affected by new shipping regulations. Currently we do not ship to the following states: Alabama, Arkansas, Delaware, Kentucky, Maryland, Massachusetts, Mississippi, New Jersey, Oklahoma, Tennessee, and Utah.
It is our goal to process and ship all orders as quickly as possible. Most orders will be processed within 24-48 hours of being placed and will arrive in approximately 7 business days.. There are several factors that contribute to when you will receive your order once it has been placed. The expediency with which your order is processed is determined by the accuracy of the order information provided by you, when the order is placed, order volume, and stock availability. The day on which your order is processed may affect when you receive it. Orders placed in the later part of the week will be held until the beginning of the following week.
It is imperative that all information included on the order be complete and accurate. Incomplete or inaccurate billing or shipping information on orders will result in a delay in processing and additional shipping charges.
If your order includes an item that is temporarily out-of-stock, but due to arrive within a few days, it will be delayed in an effort to ship the complete order. In that event we will attempt to notify you by e-mail of the delay.
Extreme weather conditions can affect your wine. High temperatures may cause your wine to leak, and extreme cold can freeze your wine during shipment. Since wine is vulnerable to extremes in temperature, and we have no control over the conditions of a carrier’s warehousing facility, we are not responsible for, and will not replace, wine that is damaged by extreme weather conditions. By placing an online order you are accepting the responsibility for that shipment through whatever weather conditions may occur during that shipment. If you live in an area where the current ambient temperature is near freezing in Winter or above 75 degrees Fahrenheit in Summer we suggest you select either 1 or 2 day shipping and be absolutely sure that an adult is available to sign for the shipment when it arrives on the scheduled day.
PRIVACY AND SECURITY POLICY
